Tenancy succession, 5/2/13

Mercy Law Resource Centre recently acted for a mother of two young children who had been requested by the Local Authority to vacate her property following the death of her grandmother.  The Local Authority advised our client that she was not entitled to succeed her grandmother’s tenancy as she did not meet the criteria that applied to grandchildren of a deceased tenant.

MLRC made representations to the Local Authority on our client’s behalf arguing that she was entitled to be treated as a child rather than a grandchild as she had lived in the property all her life with her grandmother who we argued had acted in loco parentis.  The Local Authority reviewed the file and accepted that our client was entitled to succeed the tenancy as a daughter and applied less stringent succession rules.
